By accessing or using the apps and websites (collectively, the "Services") provided by Underway Technologies LLC ("we," "our," or "us"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use our Services.

You may use our Services only in compliance with these Terms and all applicable laws and regulations. You agree not to misuse our Services, including but not limited to: interfering with or disrupting the Services; accessing the Services through automated means without authorization; or attempting to gain unauthorized access to any part of the Services.

Some features require an account. You must be at least 13 years old, and an account is for one person. You are responsible for your account and for anyone you send an invite link to while it is valid. You can delete your account at any time from your Profile page in the app; what happens to your data is described in our Privacy Policy.

You own what you create. When you share it, you grant us a worldwide, non-exclusive, royalty-free license to store it, show it to the people you share it with, and show what they add to it, for as long as it is kept (see the Privacy Policy). What you contribute to a group game becomes part of the group's result and stays with the group if you leave. You are responsible for having the right to share anything you share. Suggestions and bug reports you send us may be used without obligation to you.

Do not share content that is sexual, violent, harassing, hateful, or that you have no right to share. You can block anyone; blocking is mutual. We review reports promptly and may remove content or suspend accounts without notice.

Our Services and all associated content, features, and functionality are owned by Underway Technologies LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Services without our prior written consent.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, UNDERWAY TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICES.

You agree to indemnify and hold harmless Underway Technologies LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services or your violation of these Terms.

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease and your account data is deleted as described in our Privacy Policy; group results and unattributed reports remain.

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law rules. Any dispute arising under them shall be brought in the state or federal courts located in Washington, and you consent to their jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
